Self-employed status protection we offer

We offer one-off investigations and retained solutions for agencies, commercial contractors, labour providers and companies which engage subcontractors directly. Our solutions meet all the requirements of agencies and intermediaries surrounding CIS legislation:

Self-employed contracts

We can draft subcontractor-specific contracts that reflect a genuine self-employed working arrangement. Our subcontractor contracts remain 100% undefeated in HMRC disputes.

Tribunal representation

Most employment status cases handled by the Markel Tax team are conceded by HMRC without the need for a Tribunal hearing. However, where cases do go the full distance, we have a proven track record at Tribunal and a Markel Tax consultant who works on the case from the outset will represent you. We won the first IR35 Tribunal case Lime IT v Justin (2002) SpC 342 and have had many successful victories since then.

HMRC enquiries

Our team can advise on tactics and arguments where an employment status enquiry is ongoing. Our fees are fixed from the outset and we can review cases for a one-off fixed fee before full engagement.

Insured solutions

HMRC can challenge the status of some contractors, despite them demonstrating that their processes and procedures are reasonable. This opens up a potential exposure to tax and NIC liability. These liabilities can be insured and protect end clients for current and retrospective employer's NIC liability – an amount which can build up very quickly over time.
