Jack Poole

Jack joined Markel Law in January 2023.

Since joining the firm Jack has been involved in a range of different commercial disputes including breach of contract disputes, commercial property claims, public licencing agreements and insolvency.

Jack has also been engaged in successfully Defending clients against claims brought by various different entities including local authorities, international companies and City Councils.

Commercial Litigation

Jack has worked with a range of different clients including limited companies, consultants, public schools, care homes and product manufacturers.

His specialisms include:

• Interpreting commercial contractual terms and advising on enforcement of the same;

• Enforcing judgments in foreign jurisdictions;

• Pursuing professional negligence claims;

• Commencing proceedings for breach of commercial contracts;

• Bringing claims for breach of restrictive covenants in employment contracts;

• Defending actions for breach of settlement agreements and non-performance;

• Applying to set aside judgments which have been wrongfully entered; and

• Recovering debts owed.

Property Litigation

Jack also has experience in property litigation – working on behalf of commercial landlords, estate agents and commercial tenants. Notable areas include:

• Enforcing commercial tenant rights under the Landlord and Tenant Act 1954;

• Effecting the repossession of land occupied by unlawful trespassers;

• Pursuing claims under the Land Tribunal;

• Enforcing easements and rights of way for commercial property;

• Commercial dilapidations claims;

• Landlord and tenant disputes;

• Residential possession proceedings.

Notable cases include:

• Successfully recovered the full claim amount for repudiatory breach of contract from a multinational social networking service.

• Fully Defended a wedding supplier against a potential claim for incomplete performance on the basis of our client’s force majeure clause.

• Successfully Defended a national charity against multiple claims of negligent misstatement and defamation.

• Pursued multiple City Councils in the High Court for breaches of their Joint Framework Agreements.

• Mediated on behalf of clients in a multitude of commercial contract disputes.

• Negotiated multiple claims down on behalf of Defendants to under 20% of the original value.
